Terms and Conditions for 'VIP Unlimited' Subscription Service

1. Introduction

This agreement sets forth the terms and conditions (“Terms”) for the “VIP Unlimited” subscription service (“Subscription”) offered by (Raining Berries USF Location ONLY), owned by Ian Clementson, located in Temple Terrace, Florida (“we”, “us”, “our”). By subscribing to “VIP Unlimited”, subscribers (“you”, “your”) agree to abide by these Terms.

2. Subscription Service

The “VIP Unlimited” Subscription provides access to a select menu of beverages (“VIP Menu”), which is subject to change without notice. Currently, the VIP Menu includes one 12-ounce cup of any of the following per day: Americano, Cold Brew, Nitro Brew, or Iced Black Tea. Add-ons to these beverages are not included in the Subscription and will be charged extra.

3. Subscription Fee and Payment

The Subscription fee is $11.97 per month, billed monthly via automatic card charge through the Square Up subscription service. Prices are subject to applicable taxes.

4. Non-Transferability

The Subscription is personal to you and is non-transferable. It is limited to one 12-ounce drink per day from the VIP Menu and cannot be shared.

5. Cancellation Policy

You may cancel your Subscription at any time. Cancellations can be made in person at our Temple Terrace location or via the Square Up portal, if available.

6. Menu Changes

The VIP Menu is subject to change at our discretion and without prior notice. We will endeavor to update our subscribers of any changes, but it is your responsibility to check the current VIP Menu.

7. Usage and Limitations

The Subscription is valid only in participating locations. Additional locations may be included in the future and will be updated in these Terms.

8. Changes to Terms

We reserve the right to change these Terms and conditions, including prices, without notice. Continued use of the Subscription following any changes indicates your acceptance of the new Terms.

9. Data Use and Privacy

By subscribing, you agree that we may use your data for marketing and advertising purposes. We will handle your data in compliance with applicable data protection and privacy laws.

10. Governing Law

These Terms are governed by the laws of the State of Florida and should be construed accordingly.

11. Limitations of Liability

We are not liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Subscription service.
